Based on these indications, civil society organizations, one of which is IDEA, and a number of journalists collaborated to investigate alleged irregularities in this project. This collaboration was carried out after they attended the Goods and Services Procurement Supervision Training organized by ICW and the Government Goods\/Services Procurement Policy Institute (LKPP) on 1-3 July 2019 in Yogyakarta. <\/p>\n\n\n\n
Both parties share roles. Civil society organizations are tasked with obtaining auction documents from the Yogyakarta Provincial Government. The process of obtaining auction documents turned out to be a tortuous process. IDEA researcher Ahmad Hedar began the search for documents by meeting officials at the Procurement Service Unit (ULP) and the Public Works, Housing and Energy and Mineral Resources Agency (PUP-ESDM). This method was taken because IDEA and the government often form partnerships, for example in poverty alleviation programs. The meeting on July 24, 2019 gave Hedar hope. This is because the Head of the Cipta Karya Division of the PUP-ESDM Agency, Arief Azazie Zain, promised to provide a copy of the document within a week.<\/p>\n\n\n\n
Two weeks later, Haedar's hopes were dashed. Arief said that the PUP-ESDM Service was unwilling to submit the auction documents. The reason was that the documents were not for the public. He referred to the Decree of the Minister of Public Works Number 451 of 2017 concerning the List of Excluded Information.<\/p>\n\n\n\n
Haedar did not give up. He studied the regulation until he found a loophole. It turned out that the policy only regulated the list of information that was excluded at the central level, not at the regional level. On this basis, Haedar met Arief for the third time on August 9, 2019 and expressed his objection to the rejection. His reference was Law Number 14 of 2008 concerning Public Information Disclosure (UU KIP) which states that auction documents are not excluded documents. Failing to use the friendly approach, Haedar wrote officially to the two agencies. Once again his efforts hit a dead end. They replied to IDEA's letter and remained adamant that the requested documents could not be opened to the public.<\/p>\n\n\n\n After IDEA submitted another letter of objection, the government responded. However, the Head of the Regional Infrastructure Development Bureau, the division that oversees the ULP, actually asked for 'mediation' with IDEA. In fact, said Haedar, the KIP Law does not regulate the mediation process when someone files an objection. \"Their language is to be soft and smooth, and to obtain a win-win solution,\" said Haedar.<\/p>\n\n\n\n Haedar also met with the Assistant for Economy and Development of the Yogyakarta Provincial Secretariat and the Head of the Regional Infrastructure Development Bureau on October 28, 2019. Apparently, the 'mediation' in question was lobbying by these two officials so that Haedar would not insist on getting the tender documents. They objected to opening the tender documents on the grounds that they contained personal data of the company owner. Haedar felt this reason was odd. This is because the tender winner was working on a project that used public funds.<\/p>\n\n\n\n These officials eventually gave in. They finally agreed to hand over the documents with a number of conditions. For example, the documents were not to be disseminated and were only used for internal IDEA purposes. The results of this analysis must also be submitted to these officials. \"They only ensure that the documents are not leaked,\" said Haedar.<\/p>\n\n\n\n At the end of the meeting, the officials asked IDEA to fill out a detailed list of required information. At first, Haedar was hesitant because he was worried that there were documents that had been missed. At this meeting, several officials again warned Haedar that this document should only be used for internal research purposes and not be published. Haedar explained that IDEA would publish the results of the analysis if it found any irregularities. The two parties had some debate before the government finally agreed to provide the required documents. <\/p>\n\n\n\n They also insisted that IDEA sign a statement that points related to the prohibition of disseminating documents to other parties. The Regional Infrastructure Development Bureau also requires IDEA to submit the results of their analysis only to the Yogyakarta Provincial Government. \"We ask that the last point be revised. Proses mendapatkan dokumen lelang ternyata melalui proses berliku. Peneliti IDEA, Ahmad Hedar memulai pencarian dokumen dengan menemui pejabat di Unit Layanan Pengadaan (ULP) dan Dinas Pekerjaan Umum Perumahan dan Energi Sumber Daya Mineral (PUP-ESDM). Cara ini ditempuh karena IDEA dan pemerintah kerap menjalin kemitraan misalnya dalam program pengentasan kemiskinan. Pertemuan pada 24 Juli 2019 ini sempat memberikan harapan bagi Hedar. Sebab, Kepala Bidang Cipta Karya Dinas PUP-ESDM, Arief Azazie Zain berjanji bakal memberikan salinan dokumen dalam kurun waktu satu pekan. Dua minggu berselang, harapan Haedar pupus. Arief mengatakan bahwa Dinas PUP-ESDM tak bersedia menyerahkan dokumen lelang. Alasannya, dokumen itu bukan untuk publik. Dia merujuk pada Keputusan Menteri Pekerjaan Umum Nomor 451 Tahun 2017 tentang Daftar Informasi yang Dikecualikan. Haedar tak patah arang. Dia mempelajari regulasi itu sampai menemukan celah. Ternyata, beleid itu hanya mengatur daftar informasi yang dikecualikan di tingkat pusat, bukan di daerah. Dengan dasar ini, Haedar untuk ketiga kalinya kembali menemui Arief pada 9 Agustus 2019 dan menyampaikan keberatannya terhadap penolakan itu. Acuannya, Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik (UU KIP) yang menyatakan dokumen lelang bukan dokumen yang dikecualikan. Dia juga melampirkan sejumlah yurisprudensi putusan sengketa informasi yang mendukung pernyataan tersebut. Nyatanya, cara ini juga menempuh jalan buntu. Gagal menggunakan pendekatan perkawanan, Haedar pun bersurat secara resmi ke dua instansi itu. Lagi-lagi usahanya menemui jalan buntu. Mereka membalas surat IDEA dan tetap bersikukuh dokumen yang diminta tak bisa dibuka untuk publik. Setelah IDEA kembali mengajukan surat keberatan, barulah pemerintah merespon. Namun, Kepala Biro Pengembangan Infrastruktur Wilayah, divisi yang menaungi ULP, justru meminta \u2018mediasi\u2019 dengan IDEA. Padahal, kata Haedar, UU KIP tak mengatur proses mediasi ketika ada yang mengajukan keberatan. \u201cBahasa mereka, supaya soft dan smooth, dan memperoleh win-win solution,\u201d kata Haedar. Haedar pun menemui Asisten Perekonomian dan Pembangunan Sekretariat Daerah Provinsi Yogyakarta dan Kepala Biro Pengembangan Infrastruktur Wilayah pada 28 Oktober 2019. Rupanya, \u2018mediasi\u2019 yang dimaksud adalah lobi kedua pejabat ini agar Haedar tak ngotot mendapatkan dokumen tender. Mereka keberatan membuka dokumen tender dengan alasan memuat data pribadi pemilik perusahaan. Haedar merasa alasan ini janggal. Sebab, pemenang tender mengerjakan proyek yang menggunakan anggaran publik. Para pejabat ini belakangan mengalah. Mereka akhirnya bersedia menyerahkan dokumen dengan sejumlah syarat. Misalnya, dokumen tak disebarluaskan dan hanya digunakan untuk kepentingan internal IDEA. Hasil analisis ini pun mesti diserahkan pada pejabat-pejabat ini. \u201cMereka hanya memastikan dokumen tidak bocor,\u201d ujar Haedar. Di ujung pertemuan, pejabat-pejabat itu meminta IDEA mengisi daftar informasi yang dibutuhkan secara rinci. Pada awalnya Haedar sempat ragu karena khawatir ada dokumen yang terlewat. Untuk menyiasatinya, Haedar dan tim IDEA pun meminta semua dokumen tender sejak tahap perencanaan hingga serah terima. Pada 14 Desember, kedua pihak kembali berjumpa. Pada pertemuan kali ini, sejumlah pejabat kembali mewanti-wanti Haedar agar dokumen ini hanya digunakan untuk kepentingan riset internal dan tidak dipublikasikan. Haedar menjelaskan, IDEA bakal mempublikasikan hasil analisis jika menemukan adanya penyimpangan. Kedua belah pihak sempat berdebat sebelum akhirnya pemerintah bersedia memberikan dokumen yang dibutuhkan. Mereka juga bersikeras agar IDEA meneken pernyataan yang poinnya terkait larangan menyebarluaskan dokumen kepada pihak lain. Biro Pengembangan Infrastruktur Wilayah juga mewajibkan IDEA menyerahkan hasil analisis mereka hanya kepada Pemerintah Provinsi Yogyakarta. \u201cKami meminta poin terakhir direvisi. Jangan sampai nanti seakan-akan analisis hanya diserahkan ke pemerintah dan tidak ke yang lain (publik),\u201d pungkas Haedar. Setelah membuka dokumen yang diperoleh, Haedar cs rungsing. Dokumen yang diberikan ternyata hanya berisi rangkuman proses lelang dan aturan-aturan dalam proses penawaran. Menurut Haedar, informasi itu sebenarnya mereka bisa peroleh secara cuma-cuma di situs pemerintah tanpa melalui proses audiensi. \u201cDokumen itu kami anggap tidak berfungsi sama sekali. Tidak perlu susah payah minta dokumen,\u201d tuturnya. Haedar menduga pejabat di ULP mencurigai mereka sedang memantau proyek relokasi ini. Kendati tidak mengantongi dokumen lelang, para jurnalis tetap menerbitkan artikel penelusuran mereka. IDEA berkomitmen untuk terus memperjuangkan keterbukaan informasi untuk publik di Yogyakarta.
